1. Acceptance of Terms
By creating an account or placing an order on mohakash.store (the "Platform"), you agree to these Terms of Service. If you do not agree, please do not use the Platform.
2. What Mohakash Store Is
Mohakash Store is a multivendor marketplace: we provide the platform that connects buyers ("Customers") with independent third-party sellers ("Vendors"). Unless stated otherwise, Vendors — not Mohakash Store — are the sellers of record for the products they list, and are responsible for the accuracy of their listings, product quality, and fulfilling orders.
3. Accounts
You must provide accurate information when registering and are responsible for keeping your account credentials secure. You must be at least 18 years old, or have a parent/guardian's permission, to create an account.
4. Becoming a Vendor
Vendor applications are subject to admin review and approval. Approved Vendors agree to:
List products accurately and honestly, and only products they are legally entitled to sell.
Fulfil and ship orders promptly once accepted.
Pay the platform commission on each sale, as disclosed in the Vendor dashboard.
Provide accurate payout account details for receiving payment of their earnings.
Mohakash Store may suspend or reject a Vendor account at its discretion, including for policy violations, quality issues, or customer complaints.
5. Orders and Payment
Orders are currently paid via Cash on Delivery: no payment is collected until your order is delivered. Prices, product availability, and stock are set by individual Vendors and may change without notice prior to an order being placed. By placing an order, you agree to pay the total shown at checkout upon delivery.
6. Shipping and Delivery
Delivery timeframes are estimates and may vary depending on the Vendor and delivery location. Mohakash Store is not liable for delays caused by circumstances outside our reasonable control.
7. Returns, Refunds, and Cancellations
Orders may be cancelled before payment is collected. Return and refund eligibility depends on the product, Vendor policy, and applicable consumer protection law. Contact us or the Vendor via the Platform's messaging feature to request a return, refund, or exchange.
8. Reviews and Conduct
Reviews must reflect a genuine purchase experience and must not contain abusive, defamatory, or misleading content. We reserve the right to moderate or remove reviews and other user-generated content that violates these Terms.
9. Prohibited Activities
You agree not to use the Platform to: violate any law; infringe on intellectual property or other rights; upload harmful code; attempt to gain unauthorized access to the Platform or other users' accounts; or engage in fraudulent transactions.
10. Intellectual Property
The Mohakash Store name, logo, and platform software are our property or licensed to us. Vendors retain rights to their own product content but grant us a licence to display it on the Platform for the purpose of operating the marketplace.
11. Limitation of Liability
To the fullest extent permitted by law, Mohakash Store is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, or from the acts or omissions of Vendors, delivery partners, or other users.
12. Governing Law
These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict-of-law principles.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
